Abstract

The exclusionary rule introduced by the Chilean Criminal Procedure Reform gave way to several problems when extrapoled to non–criminal matters. From this perspective, the paper aims to analyze the core International Human Rights Treaties, to determine the scope of the right of proof, and specially its limitations concerning to excluding unlawfully obtained evidence in the International Human Rights Law.
