Constitutional and conventional protection of migrants

Abstract

This article reflects on the situation of vulnerability of migrants and the paths that must be followed in order to consider the fundamental right to migrate. In this sense, the main inter-American standards for their protection are rescued, as well as the performance of the Peruvian constitutional justice in the current context of the ius
constitutionale commune. Finally, a jurisprudential balance of the interjudicial dialogue in the guarantee of the rights of the migrants is made and the importance of the ius migrandi in the Venezuelan case is revaluated.
