How Does the Philosophy of Private Law Contribute to the Teaching and Understanding of Private Law? The Virtuous Dialogue Between Philosophical Reflection and Private Law Scholarship

Abstract

This work analyzes the contribution of the philosophy of private law to the teaching and understanding of private law. The link between philosophical reflection on private law and private law scholarships is reviewed, is reviewed, showing the dimensions in which each discipline places its respective emphasis and, in turn, the complementarity of their tasks for the formation of a virtuous dialogue between both. Finally, the role of private law philosophy is illustrated in light of the implementation of its considerations in two distinctive concerns of private law; namely, property law and contract law.
