Reports the development of the activity of "case study" developed in the context of the "educational innovation project" of the Pontifical Catholic University of Paraná, Londrina campus. It establishes that the use of active methodologies is presupposed by Brazilian Resolution 5/2018, CNE/CES, which defines that the degree course in law at Brazil, should turn to the development of competencies. The essays builds on the experience that Harvard University has made remarkable use of this strategy since 1870 and identifies the distinction between the preceding case study and the fictitious case study. It illustrates that each mode of case study has a particular understanding of the science of law (legal hermeneutics). It argues about the need to prepare students to participate with quality of the activity and provides an example of a preparatory questionnaire. At the end it presents an example of a fictitious case applied in the classroom.
